As an MPEA member you are covered by a collective bargaining agreement and as such have additional employment rights. Your rights derive from federal laws, state laws and your collective bargaining agreement. Additionally, your most important right is the right to representation for any violation of the above.
These rights include those granted by the Montana Collective Bargaining Act, FLSA, ADA, FMLA, and specific rights such as Weingarten and Garrity rights. The majority of MPEA contracts provide for “Just Cause” for termination after probation.
As an MPEA member you are not required to know these rights and how they work, however, we strongly urge you to know and understand your collective bargaining agreement. If you are having a job related difficulty YOU SHOULD CALL YOUR MPEA STAFF REPRESENTATIVE IMMEDIATELY AND DISCUSS YOUR ISSUE. THE EARLIER MPEA BECOMES INVOLVED, THE MORE MPEA MAY BE ABLE TO DO FOR YOU.
Your Contract gives you the right to fair treatment in hiring, promotion, transfer, and discipline; and it provides a process to protect your rights. You cannot be punished without Just Cause and you have the right to question the fairness of your employer.
The Montana Public Employees Association DOES NOT have the legal right to either sign a member up for payroll deduction or to delete a member from payroll deduction. New members must sign an authorization for payroll deduction which is sent to the appropriate payroll department.
A member who has a change in job status which allows the member to drop membership in the Association MUST NOTIFY THE PAYROLL DEPARTMENT AND IS PERSONALLY RESPONSIBLE TO SEE THAT PAYROLL DEDUCTION FOR DUES IS STOPPED. MPEA IS NOT LIABLE TO REFUND DUES WITHHELD AFTER THE JOB STATUS CHANGE.
